§ 1 Scope

These terms and conditions apply to all orders placed via the website xxx-agency.com with Christian Ranz, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany (hereinafter “we”). Our offer is directed at consumers aged 18 and over. The availability of individual products and services may be restricted in certain countries due to mandatory legal requirements.

§ 2 Conclusion of contract

The presentation of the products on the website is not a binding offer but an invitation to order. By completing the order process you submit a binding offer. The contract is concluded when we confirm the order by email or provide the service, whichever occurs first.

§ 3 Services

We offer: the Profile-Guide as a PDF, profile building blocks (profile picture, header, bio), profile analysis (Profile-Audit light, Profile-Audit Pro, Profile-Optimization) and coaching (Chat, Profile-Complete). The scope and content of the individual services are set out in the respective product description on the website at the time of the order.

§ 4 Prices and payment

All prices shown are total prices. No German VAT is charged under the small-business exemption pursuant to § 19 of the German VAT Act (UStG). Where Payhip is required to collect applicable taxes on digital products, these taxes are already included in the displayed price. The available payment methods are shown during the order process. In the case of payment in advance, we provide the service after receipt of payment.

§ 5 Delivery and provision of services

The PDF guide is provided by email or download link after receipt of payment. Files provided through Payhip are subject to a download limit of 2 downloads per product. Profile-Audit Pro, Profile-Optimization and building blocks are delivered by email within 48 hours on business days, counted from receipt of payment and of the information required for them. Coaching times are arranged individually; the chat week begins on the agreed start day. For all time frames we give, business days are Monday through Saturday, excluding public holidays in Bavaria.

§ 6 Cooperation

For analysis, building blocks and coaching we need from you the link to your profile, answers to a few questions and — if you wish — your own images. You warrant that you hold the necessary rights to the material you submit and that no other persons are depicted in it without their consent.

§ 7 Rights of use

The PDF guide is delivered with a personalized watermark and is intended for your own use only; it may not be passed on, published or reproduced. For delivered texts and images (building blocks, optimization) you receive a non-exclusive right of use, unlimited in time, for your own profiles. Passing them on to third parties or reselling them is not permitted.

§ 8 Right of withdrawal

As a consumer you have a statutory right of withdrawal. The details, the exceptions for digital content and services already begun, and the model withdrawal form can be found on the Right of Withdrawal page.

§ 9 Warranty and no guarantee of success

The statutory warranty rights apply. Our analyses, building blocks and coaching are consulting and design services. We cannot guarantee and do not promise any particular commercial success, reach or earnings; the decision on implementation lies with you.

§ 10 Liability

We are liable without limitation in cases of intent and gross negligence as well as for injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded. Liability under the German Product Liability Act remains unaffected.

§ 11 Discretion

We do not need a real name; an anonymous email address and your profile name are sufficient. We only share your details where this is necessary to fulfill the contract or where you choose to use an external communication service such as Telegram. For details, see our Privacy Policy.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
