Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods; for services and digital content, from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Christian Ranz, Schwabenstr. 43, 87616 Marktoberdorf, Germany, email: phs@xxx-agency.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. by email or letter). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. For goods, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If you requested that a service begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Expiry and exclusion of the right of withdrawal
For digital content (PDF guide), the right of withdrawal expires if we have begun performance of the contract after you have expressly consented to us beginning before the end of the withdrawal period, you have confirmed your knowledge that your right of withdrawal expires through this consent, and we have provided you with a confirmation of the contract on a durable medium (§ 312f BGB) (§ 356 (6) BGB). For services (Profile Audit light, Profile Audit Pro, Profile Optimization, building blocks, coaching), the right of withdrawal expires if we have fully performed the service and only began performance after you have expressly consented to us beginning before the end of the withdrawal period and you have confirmed your knowledge of the expiry (§ 356 (5) BGB). The right of withdrawal does not apply to goods that are made to your specifications or clearly personalized (§ 312g (2) no. 1 BGB).
